2. Services Description

Build Masters Constructions provides the following construction services in Bangalore, Karnataka:

  • Commercial Construction: Offices, retail spaces, warehouses, and commercial buildings
  • Turnkey Projects: Complete construction solutions from design to handover
  • Architectural & Structural Design: Planning, design, and structural engineering services
  • Interior Design: Modular kitchens, wardrobes, and interior finishing services

All services are subject to availability and applicable laws and regulations in Bangalore, Karnataka.

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about your construction requirements
  • Obtain all necessary permissions, approvals, and clearances from authorities
  • Ensure the construction site is accessible and safe for our workers
  • Make timely payments as per the agreed payment schedule
  • Provide necessary utilities (water, electricity) at the construction site
  • Communicate any changes or concerns promptly
  • Abide by the project timeline and cooperate with our project manager

4. Payment Terms

Milestone-Based Payments

Our projects operate on a milestone-based payment system:

  • Advance Payment: Typically 20-30% of total contract value
  • Foundation Completion: 20-25% of total contract value
  • Structure Completion: 25-30% of total contract value
  • Finishing Stage: 15-20% of total contract value
  • Final Payment: 5-10% upon handover

Payment Methods

We accept the following payment methods:

  • Bank transfers (NEFT, RTGS, IMPS)
  • Cheques (subject to clearance)
  • Demand drafts

Late Payment

Payments not made within 7 days of the due date may attract interest at 18% per annum. Persistent delays may result in work suspension.

5. Project Timeline and Delays

Estimated Timelines

We provide estimated project timelines based on:

  • Project scope and complexity
  • Weather conditions and seasonal factors
  • Material availability and supplier schedules
  • Government approvals and permits

Delay Circumstances

We are not liable for delays caused by:

  • Force majeure events (natural disasters, pandemics, etc.)
  • Government regulations or changes in building codes
  • Material shortages beyond our control
  • Client-requested changes or delays in approvals
  • Unforeseen site conditions

6. Quality and Materials

Material Standards

We commit to:

  • Using materials as specified in the contract
  • Providing verifiable material bills and quality certificates
  • Following industry best practices and safety standards
  • Ensuring proper waterproofing and structural integrity

Quality Assurance

Our quality assurance includes:

  • Regular site inspections by qualified engineers
  • Photographic documentation of construction progress
  • Adherence to Bangalore building codes and regulations
  • Post-construction warranty as per industry standards

7. Changes and Modifications

Client-Requested Changes

Any changes requested by the client after contract signing must:

  • Be communicated in writing
  • Include detailed specifications of the change
  • Be approved by both parties
  • Include revised cost and timeline estimates

Change Orders

All changes will be documented through formal change orders that specify:

  • Nature of the change
  • Additional costs (if any)
  • Timeline impact (if any)
  • Both parties' signatures

8. Cancellation and Termination

Client Cancellation

If you wish to cancel the project:

  • Written notice must be provided at least 15 days in advance
  • Payment for work completed up to cancellation date is required
  • Materials procured specifically for your project must be paid for
  • A cancellation fee of 10% of the remaining contract value may apply

Termination by Build Masters

We may terminate the contract if:

  • Payments are consistently delayed beyond 30 days
  • Site access is repeatedly denied or restricted
  • Safety regulations are violated
  • Fraudulent activities or misrepresentation is discovered

9. Warranty and After-Sales Service

Construction Warranty

We provide the following warranties:

  • Structural Warranty: 10 years for major structural defects
  • Waterproofing Warranty: 5 years for terrace and bathroom waterproofing
  • Workmanship Warranty: 1 year for general construction work

Post-Handover Support

Our after-sales service includes:

  • Free inspection within 30 days of handover
  • Rectification of genuine defects within warranty period
  • Assistance with utility connections and documentation
  • Maintenance guidance and support

10. Dispute Resolution

Grievance Redressal

In case of any disputes or grievances:

  • First approach your dedicated project manager
  • If unresolved, contact our customer service department
  • For serious disputes, escalate to senior management
  • Most issues are resolved within 15 working days

Legal Jurisdiction

These Terms and Conditions are governed by the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru (Bangalore), Karnataka.

11. Limitation of Liability

Our liability is limited to:

  • The contract value of the specific project
  • Direct damages arising from our negligence or breach of contract
  • Indirect, consequential, or punitive damages are excluded
  • Claims must be made within the warranty period

We are not liable for:

  • Delays caused by third parties or suppliers
  • Damage due to improper maintenance after handover
  • Issues arising from unauthorized modifications

12. Intellectual Property

All intellectual property rights in our website content, designs, plans, and construction methodologies remain with Build Masters Constructions. Clients are granted usage rights for their specific projects only.

13. Confidentiality

Both parties agree to maintain confidentiality regarding:

  • Financial information and pricing

  • Personal and contact information

14. Indemnification

You agree to indemnify and hold Build Masters Constructions harmless from any claims, damages, or losses arising from:

  • Your breach of these Terms and Conditions

  • Violation of applicable laws or regulations

15. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, government actions, pandemics, or material shortages.
